Legal opinion supports the No Kingsford Stadium Campaign

Tesco Stores case in the opinion provided by James Findlay Q.C., is incorrect. In her opinion she states, “…the use made of the Tesco Stores case by the Applicants is disputed as representing the correct application of the principles established in that case”. In her opinion, she stresses the importance of the LDP and that two sites for a stadium have been identified at King’s Links and Loirston. As such, NKS believe it is clear that the club has not presented sufficient or acceptable grounds on which to discount these sites. These sites remain sequentially preferable and available for the purposes of a football stadium. It is the inflexible approach of AFC, insisting on unreasonable design and land requirements, which are barriers to the successful adoption of either of these two sites. The legal opinion provided by Ailsa Wilson Q.C., indicates that a decision against the use of these sites may be a matter of Law.
